General Terms

These Terms & Conditions govern your use of the Soccotra website and of the services described on it. The website and the services are operated by Соккотра 111 ЕООД, trading as Soccotra, a software and growth studio based in Sofia, Bulgaria. By using the website, or by contacting us through it, you confirm that you accept these Terms. If you do not accept them, please do not use the website.

The website is provided for information and for getting in touch with us. Work carried out for a client is governed by the separate proposal or contract agreed for that work, and where that document and these Terms conflict, that document prevails for the services it covers.

Fees for services are set out in the individual proposal or contract agreed with the client.

We may revise these Terms and the way the website is provided at any time, as described in the section on changes to these Terms below.

Meanings

In these Terms & Conditions, the following meanings apply.

Use of the Website

Soccotra grants you a revocable, non-exclusive, non-transferable and limited right to access and view the website for your own personal or internal business purposes, strictly in accordance with these Terms. No other rights are granted. Rights in the work we carry out for a client are dealt with in the proposal or contract agreed for that work.

Restrictions

You agree not to do any of the following, and not to permit others to do so.

Forms on the Website

The website provides a contact form and a newsletter sign-up. Information you send through them is used to respond to your inquiry or, in the case of the newsletter, to add your address to our mailing list. Our Privacy Policy describes how that information is handled.

The contact form uses a security check provided by Cloudflare in order to limit automated submissions. Your IP address is sent to Cloudflare for that check.

Your Suggestions

If you send us feedback, comments, ideas or suggestions about the website or our services, we may use them for any purpose, without restriction and without any obligation, credit or compensation to you. Please do not send us confidential information through the website.

Links to Other Websites and Third-Party Services

These Terms apply only to our own website and services. The website may contain links to websites and services that Soccotra does not operate or control. We do not monitor them, and we are not responsible for their content, accuracy or availability. When you follow a link away from our website, these Terms no longer apply, and your use of the other site is subject to its own terms and policies. We do not use cookies for analytics, advertising or profiling, and the website carries no analytics or advertising tools. Availability of the Website

Soccotra may modify, suspend or discontinue the website, or any part of it, at any time and without notice. We may add, change or remove features and content, and we do not undertake to provide any particular feature or to keep the website available without interruption. You may stop using the website at any time, and you do not need to tell us when you do.

Term and Termination

These Terms apply for as long as you use the website. You may stop using the website at any time. If you do not comply with these Terms, we may restrict or withdraw your access to the website without notice, and you must then stop using it.

Termination does not limit any right or remedy that has already accrued to either party, and the sections on intellectual property, warranties, liability, governing law and jurisdiction survive it. An engagement for services ends in accordance with the proposal or contract agreed for that work.

Intellectual Property

The website and its contents, including text, images, layout and design, are owned by Soccotra or its licensors and are protected by Bulgarian and international copyright, trademark and other intellectual property laws. The material may not be copied, modified, reproduced or distributed, in whole or in part, without our prior written permission, except as expressly permitted in these Terms.

Copyright Infringement Notice

If you are a copyright owner, or the agent of such an owner, and believe that material on our website infringes your copyright, please contact us setting out the following information: (a) a physical or electronic signature of the copyright owner or of a person authorized to act on their behalf; (b) identification of the material that is claimed to be infringing; (c) your contact details, including your address, telephone number and an email address; (d) a statement that you have a good faith belief that use of the material is not authorized by the copyright owner; and (e) a statement that the information in the notification is accurate and that you are authorized to act on behalf of the owner.

Indemnification

You agree to indemnify and hold Soccotra and its personnel harmless from any claim or demand, including reasonable legal costs, arising out of your use of the website, your breach of these Terms or of any law or regulation, or your violation of the rights of a third party.

No Warranties

The website is provided to you "as is" and "as available", with all faults and without warranty of any kind. Under no circumstances shall Soccotra or the Soccotra team be liable for any indirect, special, incidental or consequential damages, including loss of data, loss of profit or business interruption, arising out of the use of, or the inability to use, the website or its contents, even if we have been advised of the possibility of such damages.

Where we provide services under a proposal or contract, the liability terms of that document apply to those services.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

Severability

If any provision of these Terms is held to be unenforceable or invalid, it will be interpreted so as to accomplish its objective to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

No failure to exercise, and no delay in exercising, on the part of either party, any right or power under these Terms operates as a waiver of that right or power. Nor does any single or partial exercise of a right or power preclude its further exercise. A waiver of one breach is not a waiver of any later breach.

Changes to These Terms

We may revise these Terms at any time. The current version is always published on this page, and the date of the last update is shown at the top. If a revision is material, we will make that clear on this page. By continuing to use the website after a revision takes effect, you accept the revised Terms. If you do not accept them, please stop using the website.

Entire Agreement

These Terms, together with our Privacy Policy and our Cookie Policy, constitute the entire agreement between you and Soccotra regarding your use of the website, and supersede any prior understanding on that subject. Additional terms may apply to other Soccotra services, and we will provide them to you at the time.

Governing Law and Jurisdiction

These Terms are governed by the laws of Bulgaria, excluding its conflict of law rules. Any dispute arising out of or in connection with these Terms, or with your use of the website, is subject to the exclusive jurisdiction of the competent courts of Bulgaria.
